Berlusconi lawyers ask supreme court to acquit him of tax fraud

ROME (Reuters) - Lawyers for Silvio Berlusconi asked the supreme court on Wednesday to throw out a tax fraud conviction against the former prime minister in a case that could decide not only his future but that of Italy's fragile coalition government.

The Court of Cassation heard more than three hours of arguments from Berlusconi's two lawyers challenging the verdict of a lower appeals court which sentenced him to jail and a ban from public office for the fraudulent purchase of broadcasting rights by his Mediaset television empire.

The court then adjourned until Thursday when a court official said the five judges would begin considering their decision at noon (1000 GMT/6 a.m. ET). The court can confirm the sentence, overturn it or send the case back to the appeals court for a retrial because of legal errors.

If the court confirms the sentence, there could be political turmoil in the midst of Italy's worst postwar recession.

The weak coalition government of Prime Minister Enrico Letta's center-left Democratic Party (PD) and Berlusconi's center-right People of Freedom (PDL) could be plunged into crisis, with potential fallout across the euro zone.

Berlusconi's chief lawyer, Franco Coppi, told the supreme court judges that the lower court had ignored defense arguments that Berlusconi was not directly involved in Mediaset's business dealings after he entered politics in 1994.

He said in any case the court had wrongly framed the charges, which were not fraud but an accounting offence subject to fines rather than a penal sentence.

On Tuesday, the public prosecutor asked the court to reject Berlusconi's final appeal against a four-year jail sentence commuted to one year under an amnesty. But he said a ban from public office for the four-time prime minister should be reduced from five years to three.

The 76-year-old media tycoon says he has been persecuted by leftist judges ever since he entered politics in 1994, but if he loses the supreme court case it will be his first definitive conviction in at least two dozen trials.

Because of his age, the jail sentence would be served through community service or house arrest. Followers say he would still run his party, which he founded and bankrolls and which has no clear alternative leader.

But the power and campaigning skills which have enabled him to dominate Italian politics for 20 years, since the so-called Bribesville graft investigation wiped out the old political order, would be severely curtailed.

There is speculation that Berlusconi's oldest daughter, Marina, 46 and chairwoman of his Fininvest holding company, would become the PDL's public figurehead if he is convicted.

Berlusconi's most hawkish supporters have threatened a mass desertion of the government and parliament and blocking of Italy's motorways with public demonstrations if he is convicted.

But a greater threat to the government could come from Letta's party, which is torn by a leadership struggle. Many of the party's members are already deeply uneasy about being in coalition with Berlusconi and could rebel if he is found guilty.

Politicians from all sides are waiting anxiously for the verdict, with uncertainty over Berlusconi's fate adding to inertia which has prevented Letta's fractious government from passing urgently needed economic reforms.

"The eve of the supreme court decision is accompanied by a strange silence. It is as if suddenly politics is holding its breath in anticipation of the sentence on Silvio Berlusconi," said respected political commentator Massimo Franco.

Berlusconi has repeatedly said he will not bring down the government even if convicted, but has raised doubts about whether the PD would remain loyal.

However, the former cruise ship crooner is a mercurial figure and his reaction to a guilty verdict is unpredictable.

Even if Berlusconi is convicted definitively, it could take his peers in the Senate until at least September to vote for his ejection from parliament.

The supreme court decision is not Berlusconi's only legal headache. He is also appealing in a lower court against a seven-year jail sentence in June for abuse of office and paying for sex with Moroccan-born nightclub dancer Karima El Mahroug, alias "Ruby the Heartstealer", when she was underage.

PROTECTED newts found near a ?15m golf course development have not blocked progress on the project, backers have said.

Bosses at Ramside Hall Hotel, near Durham City, hope to create the best new golf course in the North, with facilities to rival The Belfry, Celtic Manor or Gleneagles.

Great crested newts, one of the most heavily protected creatures in the UK, have been found at several spots close to the existing course.

But John Adamson, director of Ramside Estates, said there was no truth in rumours this had caused work to be suspended and construction is ?continuing well?.

Officials are working with Natural England to preserve the newt habitat and have erected boundary fences to stop the amphibians migrating onto the course.

The ?15m expansion includes an 18-hole ?Cathedral? course, 48 bedrooms taking the four-star hotel up to 130, a leisure centre, Asian restaurant, 34 executive homes and conference facilities.

It is due to be completed next year.

Mr Adamson said: ?We are now seeding tees, greens and fairways on the course and have almost completed the shaping of the entire layout.?

Keegan Bradley feels he can defend his WGC-Bridgestone Invitational title this week when he goes in search of a first win in 2013.

The 27-year-old collected the $1.4million first prize at Firestone last year, after a one-shot victory over fellow Americans Jim Furyk and Steve Stricker.
Although Bradley is a big fan of the Ohio course, which he says is "perfect" for his game, he will need to improve on a recent disappointing run of form, with no top-ten finishes since mid-May.
Despite still hunting his first tournament victory of the year, the American is 13th in the FedEx Cup standings and has shown signs of a recovery at Muirfield, where he finished tied 15th in The Open Championship.
Speaking about his chances, Bradley stated: "You must drive the ball well there. If you don't, you're not going to be able to score.
"It's a course that I've felt comfortable on the last two years, and one that I feel like every time I play, that I should have a decent shot to win the tournament."

That sounds pretty cool to me.

HTC One mini review an attractive middleweight smartphone with some drawbacks

Just weeks after we put the Samsung Galaxy S4 Mini through its paces, we're looking at the HTC One mini, another attempt to shrink a flagship down into a smaller (and cheaper) package. As you'd expect, the 4.3-inch mini looks much like the full-sized version, and that goes for both the hardware and software. In addition to its similar-looking aluminum-and-plastic frame you'll find both a 4-megapixel Ultrapixel camera sensor and HTC's Sense 5 UI, meaning automatic video highlights, Zoe and BlinkFeed all make an appearance here as well. There are, however, a few hardware drawbacks compared to the original, with the IR blaster, optical image stabilization on the camera and NFC stripped out for space- and cost-saving reasons. Can HTC launch a mid-range phone that won't get lost between similarly priced offerings and last year's discounted flagships? We'll try to reason that out after the break.

The Chinese Chesterton?s Thoughts on the Influence of Christianity on Common Law

It?s been a long time since I shared thoughts here from my faithful departed friend named John C.H. Wu.

I won?t bore you to death with the details of his life, as I?ve already done that in numerous posts before. Remember when he likened Saint Th?r?se of Lisieux as having the mind of Lao Tzu, with the heart of Confucius? He?s written some amazing stuff.

I keep teasing you with the fact that I?m reading Shusaku Endo?s novel, The Samurai. I still haven?t finished it, and I?m still not ready to post on it, but it has gotten me thinking once again of some of my favorite conversion stories. Stories from Asia. The conversion of John C.H. Wu ranks right up there as one of my all-time favorites, for sure.

I once called him a Chinese Legal Eagle, as he was a very accomplished lawyer and judge. In his first conversion to Christianity, he became a member of the Methodist Episcopal church while studying law at one of their missionary schools (Soochow University) near Shanghai. There is even a Tennessee connection, as that school was headed by one C. W. Rankin who hailed from my home state. Upon graduation from Soochow?s law school, John headed on to the University of Michigan Law School to further his studies. At Michigan, he knocked out his Juris Doctor degree in one year.

We were judges, once, and young?

Oops, I started boring you with John?s background. Sorry.

In his second Christian conversion, he swam the Tiber, see. Following being the Ambassador to the Holy See for the Nationalist Republic of China in 1947-49 (yes, mainland, pre-Communist, China had an ambassador to the Holy See long before the United States did [ahem,?1984] ), he escaped the destruction wrought by Mao?s armies and landed on his feet in the United States, as a professor of law at Seton Hall University.

Which is where he was when he wrote the book entitled Fountain of Justice: A Study in the Natural Law (Sheed & Ward, 1955). What follows is a passage from the eighteenth chapter, ?The Fountainhead of Legal Wisdom,? in which John gives us a clinic on the depth and breadth of the impact Christianity has had on the development of law in England, and in the United States.

One of the greatest decisions in contemporary England was the ?Snail?s Case? (Donoghue v. Stevenson.?1932. L.R., A.C. 562). The plaintiff, a poor woman, and a friend visited a cafe in Paisley, where her friend ordered for her a bottle of the ginger-beer. As she was drinking, a decomposed snail floated out with the ginger-beer. In consequence of her having drunk part of the contaminated contents of the bottle, she contracted a serious illness. She sued the manufacturer for damages. The lower courts dismissed her action on the ground that there was no privity between the manufacturer and the ultimate consumer. In the House of Lords, her appeal was upheld. What interests us here is the very practical application made by Lord Atkin of Christ?s teachings. ?The rule,? he said, ?that you are to love your neighbor, becomes in law, you must not injure your neighbor; and the lawyer?s question, Who is my neighbor? received a restricted reply. You must take reasonable care to avoid acts or omissions, which you can reasonably foresee would be likely to injure your neighbor. Who, then, in law is my neighbor? The answer seems to be?persons who are so closely and directly affected by my act that I ought reasonably to have them in contemplation as being so affected when I am directing my mind to the acts and omissions which are called in question.?

This is one of the best statements on the relation between natural law and human law. Natural law is the common fountain of ethics and jurisprudence. The functions of these latter are different. Each has its forte, and each its limits. The differences and interrelations between law and morals present a fascinating subject of study, but we shall not enter upon it here. All that I wish to say now is that if the law does not require everyone to act as the Good Samaritan, it is not because it is not sufficiently Christian to appreciate the beauty of moral goodness, but rather because it is aware of its own limits, and it has to take account of the frailties of human nature and the actual state of civilization. Jurisprudence would not be prudent if it tried to go beyond the limits of practicability. On the other hand, it would not be just if it did not perform its function as fully as it could within those limits. The end of the law is love, and no measure is set to the end, only to the means. In many matters, the law has to choose the lesser evil.

Oftentimes the legislator or the judge finds himself in the delicate position of that householder in the parable who had to refrain from action for fear that ?perhaps while you are gathering the tares you will root up the wheat with them? (Matt.xiii. 29). Some weeds, however, are so poisonous that if you do not uproot them immediately the wheat itself will be infected. In such a case, a good judge would not hesitate to pluck them out carefully, so as not to injure the wheat.

Take, for instance, the ?Spring-gun Case,??Bird v. Holbrook?(Court of Common Pleas, 1828. 4 Bingham 628), where the defendant placed in his garden a spring-gun in order to catch anyone who should come to steal the flowers. The plaintiff, who entered the garden not for stealing, but to help a friend to recapture a pea-fowl which had flown into the garden, accidentally touched one of the wires attached to the spring-gun, which was thereby discharged, causing a severe wound in his knee.

Holding the action maintainable, Chief Justice Best said, ?It has been argued that the law does not compel every line of conduct which humanity or religion may require; but there is no act which Christianity forbids, that the law will not reach: if it were otherwise, Christianity would not be, as it has always been held to be, part of the law of England. I am, therefore, clearly of opinion that he who sets spring-guns, without giving notice, is guilty of an inhuman act, and that, if injurious consequences ensue, he is liable to yield redress to the sufferer. But this case stands on grounds distinct from any that have preceded it. In general, spring-guns have been set for the purpose of deterring; the defendant placed his for the express purpose of doing injury; for, when called on to give notice, he said. If I give notice, I shall not catch him.? He intended, therefore, that the gun should be discharged, and that contents should be lodged in the body of the victim, for he could not be caught in any other way.?

You will note that in such cases Christianity is introduced not as a supernatural religion, but as a vehicle of the precepts of natural law and justice.

Likewise, in the interesting ?Queue Case,??Ho Ah Kow v. Nunan?(Circuit Court, D. Calif., 1879, 5 Sawy. 552, 12 Fed. Cas. 253), where the sheriff, in obedience to an ordinance declared unconstitutional by the Court, cut off the queue of a Chinese, and was ordered to pay damages to the amount of ten thousand dollars. Justice Field, who was sitting as Circuit Judge, had this to say in the course of his splendid opinion: ?The ordinance is known in the community as the ?Queue Ordinance,? being so designated from its purpose to reach the queues of the Chinese, and it is not enforced against any other persons. The reason advanced for its adoption, and now urged for its continuance, is, that only the dread of the loss of his queue will induce a Chinaman to pay his fine. That is to say, in order to enforce the payment of a line imposed upon him, it is necessary that torture should be superadded to imprisonment. Then, it is said, the Chinaman will not accept the alternative, which the law allows, of working out his fine by his imprisonment. Probably the bastinado, or the knout, or the thumbscrew, or the rack, would accomplish the same end; and no doubt the Chinaman would prefer either of these modes of torture to that which entails upon him disgrace among his countrymen and carries with it the constant dread of misfortune and suffering after death. It is not creditable to the humanity and civilization of our people, much less to their Christianity, that an ordinance of this character was possible.?

It is not possible to cite even a small fraction of the cases where the influence of Christianity reveals itself with sudden, blinding radiance. But the few instances I have given are representative.

Christ does not enter into the courtroom as the Lawgiver whose words are legally binding on the judges. No, His kingdom does not belong to this world. The common-law judges have quoted His words just as the judges of ancient China would quote the words of Confucius. But just as it is impossible to understand the old Chinese jurisprudence without a knowledge of Confucianism, so it is impossible to grasp the spirit of the common law without taking account of the permeating influence of Christianity.

Boxing champ Manny Pacquiao has set his sights on a new title -- president of the Philippines.

In a recent interview, the fighter nicknamed Pacman, who is already a beloved icon and congressman in his homeland, has hinted he is considering leading his nation when he retires from the ring.

In the Agence France-Presse chat over the weekend, Pacquiao was grilled on his political ambitions and when he was asked if he was interested in the top job, he said, "Yes."

"When I started boxing, of course I was planning, you know, and thinking about getting to become a champion," he said.

"So when I enter politics it's the same thing. But, you know, it's far away. It's God's will."

Pacquiao was elected into the Philippine House of Representatives in a landslide victory in 2010.

His retirement grows ever nearer after 54 victories and two losses, which came in his last two fights.

He is set to face Brandon Rios in November.

Android dominates tablet sales while iPad stumbles

Google's new Nexus 7 tablet, unveiled last week.

Android tablets have officially solidified their status as the best-selling slates in the world, says a new report by Strategy Analytics. According to the market research group, approximately 34.6 million Android tablets were shipped in the second quarter of 2013. That?s up from 18.5 million shipped in Q2 2012. Apple, on the other hand, shipped 14.6 million units in the second quarter of 2013, down from 17 million in the same quarter last year.

Overall, Android now owns an impressive 67 percent of the global tablet market, an increase from 47.2 percent in the second quarter of 2012. Apple?s market share took a nosedive, falling from 47.2 percent in the second quarter of 2012 to 28.3 percent in the second quarter of 2013.

Of course, there is a fundamental difference between Android and Apple tablets in that there are several manufacturers that produce Android devices, such as Acer, Amazon, ASUS, Samsung, Google and others.

As Strategy Analytics points out, the second quarter of 2012 also saw the launch of the iPad with Retina Display, which could explain why Apple?s shipments were higher last year than this year.

Microsoft, which launched its Surface RT and Surface Pro tablets in October and February, respectively, made a slight dent in the tablet market by moving 2.3 million units, bringing Redmond?s total tablet market share to 4.5 percent. Microsoft?s share may increase further, albeit for a brief period, due to the company?s decision to slash prices on its Surface RT.

Iran seeks key position on U.N. disarmament committee

UNITED NATIONS (Reuters) - Iran is campaigning for a key position on a U.N. General Assembly committee that deals with disarmament and international security amid strong criticism from Israel and others who accuse Tehran of seeking to develop nuclear weapons.

Iran is competing against Kuwait to be the rapporteur of the U.N. General Assembly's First Committee for its 68th session, which begins in October, U.N. diplomats said. The rapporteur reports on the proceedings of the 193-member committee.

A spokesman for Iran's U.N. mission confirmed the country's bid on Tuesday. Asked why Tehran was interested in the position, he said: "It's a normal routine by a member state."

The First Committee considers all disarmament and international security matters, cooperation in the maintenance of international peace and security, as well as principles governing disarmament and the regulation of armaments.

Western powers accuse Iran of seeking to develop nuclear weapons. Tehran says its nuclear program is for generating electricity and other peaceful purposes. Iran says U.N. sanctions imposed over its nuclear and ballistic missile programs are illegal and refuses to comply with them.

"Allowing Iran to be on the U.N. committee dealing with nuclear disarmament and weapons proliferation is like inviting Assad, the Syrian dictator responsible for the death of 100,000 of his own people, to be the head of the population census bureau," Israeli U.N. Ambassador Ron Prosor said in a statement. Israel is widely believed to possess the Middle East's only nuclear arsenal.

Earlier this month Iran withdrew its candidacy for the U.N. Human Rights Council without explanation. Tehran's bid for a spot on the 47-nation Geneva-based human rights body was sharply criticized by the United States and Israel.

Syria is still in the race for a seat on the Human Rights Council amid criticism by Western states. Syrian President Bashar al-Assad's government and rebels are locked in a civil war that started more than two years ago.

Ohio gallery is mini-Cooperstown for baseball fans

MONTGOMERY, Ohio (AP) ? Shoeless Joe Jackson might have asked if THIS is heaven.

Here was one of his thick-handled bats, being gripped lovingly and studied for cleat nicks and baseball smudges from games he played nearly 100 years ago. Newly arrived, it soon will be carefully displayed, near a rare Jackson signature, and in the days and years to come, it will be viewed by dedicated fans who will also be mingling with stars of the game.

Jackson, depicted in the movie "Field of Dreams," was banned from baseball for his role in the 1919 "Black Sox" World Series-fixing scandal, by lore disappointing a young fan who shouted: "Say it ain't so, Joe!" But the ill-fated star has a place amid such greats as Babe Ruth, Ty Cobb, Mickey Mantle and Hank Aaron in the Green Diamond Gallery in suburban Cincinnati.

The gallery showcases a top private collection of baseball memorabilia while hosting a small club of fans who in recent months have been able to ask pitcher Jack Morris about falling short of making the Hall of Fame, slugger Jose Canseco about illicit steroid use, and manager Tony La Russa about secrets of the St. Louis Cardinals' success.

"There's Cooperstown, then it's Green Diamond, and I don't know what would be a close third," La Russa said, referring to the National Baseball Hall of Fame and Museum, celebrating its annual induction weekend in upstate New York. The Hall's president, Jeff Idelson, has visited the gallery and agrees it's unlike anything else he's seen outside Cooperstown.

The gallery's roots are in a child's first trip to a baseball game five decades ago.

Bob Crotty still savors memories of the sights, sounds and smells of Crosley Field, then home of the Cincinnati Reds. He was drawn to the souvenir stand, buying buttons and other inexpensive trinkets.

And so it began.

"Once I got the bug, I got it pretty bad," Crotty said.

The preteen boy cut lawns for cash to fund his new passion, and he spent hours writing letters to teams requesting yearbooks and other items. His bedroom desk and shelves filled, then his entire bedroom, then the family's basement.

He networked with collectors and learned the best auction houses and authenticators while becoming a top executive in the family-run Van Dyne Crotty uniform company. When it was bought in 2006 by industry giant Cintas Corp., Crotty suddenly had plenty of time and money ? and a very large collection.

"I was pretty much at a crossroads ... either get rid of all this stuff or do something with it," said Crotty, now 54. He met with Kevin Manley, who had worked for a nonprofit that Crotty's company supported, to brainstorm.

Most collectors by nature want to protect their privacy and valuables, so not many fans get to view what they have.

"I always wanted to give this a home where I could display it, share it in some capacity, maybe create an environment where we could do something different," said Crotty, who made Manley the manager of what opened in 2007. It included:

? A one-floor exhibit area packed with 4,000 items such as autographed baseballs, game-used jerseys, ballpark relics, rare documents, photos and letters, organized into categories such as Hall of Famers, greatest teams, the Negro Leagues and a tribute to character and courage honoring Jackie Robinson, Lou Gehrig and Roberto Clemente.

? A private club, initially 100 dues-paying members, then upped to 250 with two levels of membership. The club, which includes female members, has a waiting list for the few spots in the top-level Wright Society that open each year, at $2,000 annual dues.

? A charitable foundation, supporting baseball-related activities for economically disadvantaged youths and disabled and sick children. Hall of Fame catcher Johnny Bench has headlined fundraising events.

? Monthly receptions, featuring question-and-answer sessions with baseball's stars and characters. Hall of Fame pitchers Steve Carlton, Bert Blyleven and Jim Bunning (also a former U.S. senator) were among last year's speakers, and hitting star Rod Carew is coming up in August.

"I was overwhelmed," said La Russa, who spoke last month. "The collection is staggering, the whole concept of the club ... You are surrounded by people who love the game."

Among them: Buck Newsome, an investment adviser who was part of initial word-of-mouth membership recruiting.

"I was like a little kid again. It was just unbelievable," Newsome recalled. "Within five or 10 minutes, I asked, 'How do I join?'"

Newsome tries to make every meeting, appreciating the chance to rub elbows with stars in a convivial atmosphere for hearing inside stories. Speakers like talking baseball with knowledgeable fans who aren't hounding them for autographs; after visiting, La Russa decided to help arrange for a Cardinal predecessor, Hall of Famer Red Schoendienst, to make an upcoming appearance.

Rentals for special events such as off-site corporate meetings and wedding rehearsal dinners help cover operating costs. Tight space and security concerns restrict numbers of visitors, but the gallery opens once or twice a year for paid tours.

Crotty, meanwhile, keeps adding. Besides the Jackson bat, he just bought Warren Spahn's Hall of Fame ring after the late pitcher's son put memorabilia up for auction. He doesn't disclose prices paid and said the only way to know the value of his collection would be to sell it.

"When you're a collector, it can be a lonely journey," Crotty said. "The beauty of having this model is I can continue to collect, and I've made friendships and relationships you can't put a monetary value on."

Microsoft has revealed the prices of two of the Xbox One's key accessories.

Microsoft revealed early Monday the prices for two of the key accessories for the upcoming next-generation Xbox One video game console ? the standalone controller, which will cost $59.99, and an official Xbox-branded wireless headset to support the consoles various chat and voice features for an additional $24.99. Like most video game hardware, the starting bundle that Xbox One owners receive will include a single controller, and Microsoft has said that the new device will not be compatible with current-generation Xbox 360 controllers.

For a point of comparison, Sony's upcoming PlayStation 4 console ? which at a starting price of $399.99 will debut for $100 less than the Xbox One ? comes bundled with an earbud-style headset but will only offer its motion-controlled camera peripheral, the imaginatively named PlayStation Camera, for an extra $59.99. Unlike the Xbox One's Kinect hardware, the PlayStation Camera is not a mandatory feature for the PlayStation 4 console. Additional PS4 controllers also cost $59.99, and the console is not backwards compatible with older versions of the PlayStation DualShock controller.

Regardless of whether or not a headset is contained in the starting console package, however, that most serious gamers will likely look to make a heftier investment in a high-end gaming headset like those offered by Turtle Beach, Tritton, or Astro if they're actually planning to use either console's chat capabilities for actual gameplay purposes. According to a report from the video game site Polygon, Sony has confirmed that the PlayStation 4 will be compatible with the same headgear that currently befits the PlayStation 3. Microsoft, meanwhile, has been vague on whether or not gamers will be able to use their current headsets, which can run upwards of $200 for the best models, on the next-gen hardware.

Despite being a relatively new corporate discipline, expectations for ERM value are already very high. A recent poll shows us why corporations are desperate for?ERM managers to be successful.

The poll, conducted by Harris Interactive of 23,000 corporate full-time employees within key industries and in key functional areas1?highlights some the challenges ERM is up against, namely, the inability of corporations to focus on and execute their highest priorities. Consider a few of their most stunning findings:

  • - Only 37% have a clear understanding of what their organization is trying to achieve and why.
  • - Only one in five was enthusiastic about their team's and organization's goals.
  • - Only one in five said they have a clear "line of sight" between their tasks and their team's and organization's goals.

Getting an accurate pulse on strategic objectives is challenging, as these goals are cross-functional and effect oriented in nature, and as such are extremely useful for the board and senior executives, but are impossible to take action on without first breaking them down into root-cause, actionable, silo specific activities within an operational processes. This is where risk management plays a pivotal role.

To create value through ERM, organizations need to build a robust?risk taxonomy, which provides a holistic view of all information and relationships across the organization. The risk manager is responsible for setting the standards, practices and procedures for effective risk management and embedding them in all existing business processes. Formalized risk assessments allow risk managers to leverage existing activities in an objective, quantifiable, repeatable manner to show how risks and activities at the business process level are impacting business goals, along with the priority and importance of these risks, activities, and goals.

A formalized risk taxonomy framework is a mechanism to collect risk information at the activity level, where most operational risks materialize, and aggregate this risk information to a level and format senior management cares about. Ecuador striker Christian Benitez dies in Qatar, according to the Al Jaish football club

DOHA, Qatar - Ecuador striker Christian Benitez died Monday, a day after playing in a match for Qatari club El Jaish, the team said.

The club said the 27-year-old Benitez, who moved from Mexican club America to play in Qatar this year, died Monday but provided no further details.

"The club would like to offer its sincere condolences to the family of the player," the club said in a statement. "His sudden departure is a big shock for each member of the technical and administrative staff. He was a player that over the short period he was here was regarded for his high moral character."

El Jaish played Qatar Sports on Sunday in the Sheik Jassim Cup, a warm-up tournament for the upcoming football season. Benitez, who also spent a season in England with Birmingham, was in the lineup.

The match was played in hot and humid conditions, which are typical of the Persian Gulf at this time of year.

"The player participated for the first time with the team during yesterday's match against Qatar Sports Club in the Sheik Jassim Cup without complaining of any health problems," the club said.

Qatar will host the 2022 World Cup and the searing temperatures have prompted many former football stars as well as FIFA President Sepp Blatter to call for the competition to be moved to the cooler, winter months. Blatter plans to ask FIFA's executive committee later this year to move it.

How US, Russia can agree on missile defense

US and Russia relations are in a nosedive over Eric Snowden, Syria, and Iran. One way to reverse that is for Presidents Putin and Obama to agree on missile defense at a planned summit in September. US-Russian cooperation in space can serve as a model.

Whether it?s over issues like leaker Eric Snowden or Syria and Iran, the US and Russia seem to end up on opposite sides of most major problems. But that trend could soon reverse ? at least regarding one contentious subject.

On Aug. 9, American and Russian defense and foreign ministers are expected to meet with their US counterparts in Washington. They will try to find ?deliverables? for a summit between President Obama and Russian President Vladimir Putin in September. The two leaders would meet in advance of a G20 summit in St. Petersburg, Russia, Sept. 5-6.

According to Russia?s deputy defense minister, Anatoly Antonov, the August meeting will focus on missile defense, a thorny problem that has divided the two countries and scuttled new initiatives in arms control and security. The US maintains its proposed defense shield in Europe is only to protect against long-range Iranian missiles; Moscow objects, saying it could be used against Russia.?

In remarks at a NATO meeting July 24, Mr. Antonov may have signaled new Russian flexibility. He did not renew Russia?s long-standing demand for legally binding guarantees that US missile defenses won?t undermine Russia?s strategic nuclear forces. Instead, he called for a US-Russian document that would ensure that the Russian Defense Ministry's contributions to a cooperative project on missile defense would not be later used against Russia. ?We are simply bound to find solutions to the problems that are dividing us," Antonov said.

Over the years, US and Russian presidents have proposed various forms of cooperation in missile defense in order to build trust and improve security, but they have failed to find a way to implement their ideas. To strike a deal on missile defense, Obama and Putin should follow the example of their countries? cooperation in space as a model in carrying out that deal.

Space and rocket science were at the heart of US-Russian strategic competition during the 1950s and ?60s. No one then envisioned the two countries sharing a glass of Tang, much less sensitive space technologies.

But gradually, with permission and guidance from the top, the countries began opening up cooperation in space. When the Cold War ended and defense budgets on both sides declined, the realm of space exploration transformed from one of confrontation into one of cooperation. The reason was primarily economic. Russia and the US found that together they could afford to do what they could not do separately.

The political and technical realities of today preclude a fully joint US-Russian missile defense system. ?Nevertheless, even a modest level of cooperation could provide better and cheaper overall defense for both sides. The way in which the US and Russia changed their space competition into cooperation can serve as a model for changing the relationship in missile defense. Here are five steps the governments can borrow from space cooperation:

Set common goals. The US and Russia could not have achieved cooperation in space, if they had not agreed on common goals, such as building the International Space Station. Moscow and Washington should focus on a common goal of protecting against ballistic missile threats.

Synchronize bureaucracies. In 1992, Moscow created the Russian Space Agency, providing NASA a direct counterpart, greatly facilitating cooperation. Russia should do the same for the US Missile Defense Agency.

Establish legal frameworks. Beginning in 1992, legal agreements allowed for the first launch of a US satellite on a Russian rocket and docking of US shuttles at Russia?s space station. Similar agreements are needed to enable businesses from both sides to risk money in missile defense cooperation.

Ease technology-sharing restrictions. The US and Russia could benefit from technology sharing in missile defense if both governments would open the door for industry to pursue cooperation. This has already been done in space for some of the same companies that do missile defense.

Explore cost-cutting synergies. Hi-tech US and Russian businesses found ways to collaborate when freed to do so by their governments. They successfully cut costs while protecting national and industrial secrets. They can do the same in missile defense.

It?s always darkest before the dawn. This could be the time for the two presidents to really lead. Cooperation in space exploration proves that the relationship does not have to remain at the bottom of the well.?

Michael Chiesa gets first loss by tapping just before the round ended at UFC on Fox 8

Going into his fight with Jorge Masvidal at UFC on Fox 8, "The Ultimate Fighter" winner Michael Chiesa was undefeated. Now, he has a loss on his record that he probably will think about for the rest of his career. Masvidal won with a D'arce choke at 4:59 in the second round.

Fighting in his home state of Washington, Chiesa started the fight well. In the first round, Chiesa knocked Masvidal to the ground, and looked close to finishing the fight first with strikes, and then with a choke. Masvidal recovered, returned to his feet, and managed a few shots of his own.

Later in the second round, Masvidal rolled Chiesa into a D'Arce position just before the clapper that announces 10 seconds left in the round sounded. Masvidal squeezed, and Chiesa tapped right before the horn sounded to end the second round. The fight was stopped, and Masvidal earned the win at 4:59 in the second round.

Chiesa stormed out of the cage as Masvidal celebrated his win. There was bad blood between the two before the fight as Masvidal complained about Chiesa's beard and Chiesa said he wasn't happy with Masvidal's smack talk. Between the bad blood, and Chiesa tapping with barely any time on the clock, he will want that fight back.

Driving in the US peaked back in 2004, according to two recent studies. And due to factors like increased used of mass transit and less interest in car ownership, driving rates may never recover to the levels of their early-aughts heyday.

Back in May, the ?U.S. Public Interest Research Group (PIRG) published?a study that showed Americans are driving less.

The PIRG study made a number of intriguing claims, all of which pointed to the fact that driving in the U.S. peaked in 2004. And due to a range of factors -- notably, the increased use of mass transit and less interest in car ownership -- it's unlikely that driving rates will ever fully recover.

Now,?Michael Sivak of the University of Michigan Transportation Research Institute has published a study of his own that seems to back the PIRG's claims.?

To reach his conclusions, Sivak examined driving trends in the U.S. from 1984 to 2011. He paid particular attention to the distances traveled per licensed driver, per vehicle, and per household.?

On each of those counts, the figures have plummeted since 2004.

According to a press release, the number of miles driven per licensed driver and per household have both tumbled 9 percent. The number of miles traveled per registered vehicle is off 5 percent:?

The latest rates (2011) are: distance driven per person, 8,494 miles (down from 9,314 in 2004); distance driven per licensed driver, 12,492 miles (down from 13,711 in 2004); distance driven per household, 22,069 miles (down from 24,349 in 2004); and distance driven per registered vehicle, 11,318 miles (down from 11,946 in 2004).

Like the PIRG, Sivak says that Americans haven't simply been driving less because of the slumping economy. American driving peaked in 2004, years before the Great Recession hit, and the figures haven't recovered at the same pace as the financial sector.

In other words, Americans (and likely others around the world) think about cars and transportation differently now, causing a shift in our driving habits.

Florida man sets fire to apartment block and kills six in shooting rampage

Zogby said Vargas then ran through the building, firing "at random, in a very irrational fashion."

"He kept running from us as he fired at us, and we fired at him," Zogby said.

He forced his way into another apartment and took two people hostage at gunpoint.

Ester Lazcano, who lives two doors down from where the shooting began, said she was in the shower when she heard the first shots, then there were at least a dozen more.

"I felt the shots," she said.

Miriam Valdes, 70, lives on the building's top floor ? one floor above where the shooting began. She said she heard gunfire and later saw smoke and what smelled like burned plastic entering her apartment, and ran in fear to the unit across the hall.

A crisis team was able to briefly establish communication with Vargas. Sgt. Eddie Rodriguez said negotiators and a police special weapons and tactics team tried talking with him from the other side of the door of the unit where he held the hostages.

Valdes said she heard about eight officers talking with him as she stayed holed up at the neighbouring apartment. She said officers told him to "let these people out."

"We're going to help you," she said they told him.

She said the gunman first asked for his girlfriend and then his mother but refused to cooperate.

Rodriguez said the talks eventually "just fell apart." Officers stormed the building, fatally shooting the gunman in an exchange of gunfire.

"They made the decision to go in there and save and rescue the hostages," Rodriguez said. Both hostages survived.

Neighbours said the shooter lived in the building with his mother. Police don't believe she was home at the time of the shootings.

"He was a good son," Lazcano said. "He'd take her in the morning to run errands" and took her to doctor appointments.

But Valdes said he was known as a difficult person who sometimes got into fights and yelled at his mother.

"He was a very abusive person," she said. "He didn't have any friends there."

Zogby said police are investigating any possible disputes between Vargas and the building manager but don't yet have any information on a possible motive. "Nobody seems to know why he acted the way he acted," Zogby said.

He said police had not responded to any prior calls at his home or found any criminal background on Vargas.

On Saturday, Agustin Hernandez ? the brother-in-law of victim Niebles ? moved his relatives' things out of the apartment building and into his car. Among them were several photos, one showing the teen smiling in a red graduation gown, another of his sister-in-law in a white dress and pearls.

Hernandez said Simono was a friend of the building manager.

Police didn't identify the slain teen, but Hernandez's wife, Zulima Niebles, said her name was Priscila Perez.

Marcela Chavarri, director of the American Christian School, said Perez was about to enter her senior year at the school.

"She was a lovely girl," Chavarri said through tears. "She was always happy and helping her classmates."

In Hialeah ? a suburb of about 230,000 residents, about three-quarters of whom are Cuban or Cuban-American ? the street in the quiet, apartment-building-lined neighbourhood was still blocked by tape Saturday afternoon.

The building where the standoff occurred is an ageing, beige structure with an open terrace in the middle. It has 90 to 95 units. The apartment where neighbours said the shooting started was charred, the door and ceiling immediately outside burned black.

Zogby called the whole building a crime scene. "He probably fired dozens of shots during the whole incident," he said.

"It could have been a much, much more dangerous situation."
