Parks chief gets a Brockton apartment to comply with law, says mayor

Mayor says Carpenter meets residency requirement by renting apartment

Parks superintendent Tim Carpenter has met the city?s residency requirement by renting an apartment near Main Street, Mayor Linda Balzotti said.

Carpenter told The Enterprise on Thursday that he is renting an apartment in the city as a ?stop-gap measure.? The disclosure from Balzotti and Carpenter came a year to the day after Carpenter started his city job, which was also the deadline for him to establish residency in the city.

Carpenter has been a city department head since last August and had one year to comply with the city?s requirement that employees live in Brockton. When hired for the $84,000-a-year job, Carpenter assured city officials he would move his family to the city in the required timeframe.

He could have faced termination had he not complied with the requirement by Thursday, according to the residency ordinance, voted in by a 3-to-1 margin in 1992. Carpenter said he got an apartment within the last week-and-a-half.

The four-member Parks Commission, which hired Carpenter, voted in July to recommend that the City Council grant Carpenter an extension on the one-year requirement. The extension request was on the agenda for the City Council?s Sept. 10 meeting of the Finance Committee, and city officials were awaiting a ruling from the Law Department whether an extension would be allowed under the residency language.

Carpenter said recently that he listed his East Bridgewater home on the market in April but has yet to receive a bid. He purchased the home in 2006. Paperwork indicates he refinanced the home in March, just before putting it on the market.

?I like my job and I want to keep my job,? Carpenter said. ?I?m in a difficult situation in terms of selling my home.?

Parks Commission Chairman Thomas Frizzell Sr. said that Carpenter has been a great addition to the city.

?I think the most important thing was that he did establish residency, and I would hope that he would live in Brockton for a long time to come,? Frizzell said.

Carpenter would not provide his address, but Frizzell said his apartment is on Newbury Street. Carpenter also did not specify the size of the apartment or the amount he is spending on rent. He did say that he will reside in the apartment.

His wife and children live in East Bridgewater.

?I will be there at some point every day ? guaranteed,? Carpenter said.

He is in line this month for a boost in his annual salary from $84,000 to more than $90,000. He drives a city-owned vehicle.

Balzotti informed the City Council on Wednesday that the city?s personnel office notified her that Carpenter is in compliance with the city?s residency requirement.

Balzotti said in an interview Thursday that in renting an apartment Carpenter ensures that he keeps his job.

?This is probably the best solution right now,? Balzotti said. ?He has established his residency in the city and he?ll work out whatever he needs to work out with his own family issues.?

Ward 3 City Councilor Dennis Eaniri said that renting an apartment in the city is better for Carpenter than continuing to live in East Bridgewater. But Eaniri said he feels he has a longer way to go to become a resident, including registering to vote in Brockton and paying taxes in the city.

?It just puts a Band-Aid on the situation,? Eaniri said.

Ward 5 City Councilor Dennis DeNapoli said he feels that the matter of Carpenter?s residency is closed.

?If he complies with the city ordinance that he?s an official resident of this city, I think it?s a done deal,? DeNapoli said.

Carpenter, DeNapoli said, is legally complying with the law, whether or not he completely moves into the city. The city?s ordinance does not detail a definition of residency.

?It?s another way of getting around the system,? DeNapoli said.

DeNapoli and Eaniri both said that city voters should revisit the law through a ballot measure ? whether to strengthen the requirement or remove it.

?The key to the residency law is who is going to go out to get the signatures and who is going to put it on the ballot?? DeNapoli said.

Russian murder suspect denies Pussy Riot link

Russian investigators said Friday they had detained a professor who confessed to trying to mislead the police by scrawling "Free Pussy Riot" in blood on a wall after murdering a mother and her daughter.

The shock discovery of the message in support of the jailed female members of the anti-Kremlin punk band created a furore in the Russian media and became top news on state TV channels.

Several reports and some top Russian websites openly accused a backer of the band of killing the women -- a charge that folds into the Kremlin's attempts to paint members of President Vladimir Putin's opposition as extremists.

But the federal Investigative Committee said 38-year-old Kazan university professor Igor Danilevsky confessed to dating the younger woman and stabbing her to death during an argument over finances and vacation plans.

Investigators said the man said he killed the mother as a witness.

"Before leaving, in order to remove any suspicion from himself and make it seem like a ritual killing, he arranged the victims' bodies in a certain manner and wrote 'Free Pussy Riot' on the wall with their blood," the committee said in a statement.

The incident occurred on August 22 -- just five day after a Moscow court convicted the band members of "hooliganism motivated by religious hatred" for their protest performance in Russia's main cathedral.

The sentence was condemned by the West as another example of how freedom of expression has suffered in Russia since Putin's initial rise to power 12 years ago.

The "punk prayer" stunt was staged in Moscow's Christ the Saviour Cathedral just weeks before Putin's March 4 election to an historic third term.

The band's defence attorneys on Thursday called the message at the murder scene an attempt to cast the supporters of Pussy Riot and the broader anti-Putin protest movement in a bad light.

Twitter to let advertisers target tweeters

Twitter will begin allowing advertisers to directly target users based on the interests they reveal in their tweets, the social media company said Thursday.

In an effort to draw advertisers to its paid ads program, the company also slashed the minimum price of "promoted tweets" to just a penny.

No longer content to be a "dumb" bulletin board, with 400 million micro-messages posted daily, Twitter has moved to a strategy of actively sifting through what each user is reading and tweeting in order to discern every individual's interests.

Google has long reaped huge profits by displaying ads based on what a user searches for in its search engine, while Facebook, a Twitter competitor, encourages users to proactively input their "likes." But Twitter has long faced the challenge of indirectly inferring these preferences.

Twitter will now allow companies to send paid ads in the forms of tweets to groups of users, bunched in more than 350 interest categories curated by Twitter itself.

CEO Dick Costolo has said in recent months that his company's value lies in its ability to mine its flow of information to build "an interest graph" showing its users' preference profiles -- which could be used by marketers to deliver targeted and relevant ads.

For instance, sports apparel retailers can target soccer fanatics for promotions, or film distributors might send tweets directed at keen Bollywood fans.

The new offering will allow companies to reach a "very narrow, very specific and incredibly focused audience," Kevin Weil, a Twitter director of product management, said in an interview.

Twitter engineers believe they can build a compelling ad delivery platform, particularly if marketers craft ads that seem to blend in with the tone and format of the service's flow of tweets, which are seen by some 140 million monthly active users.

In building its interest graph, Twitter analyzes "a host of signals," Weil said, including which accounts a user follows, as well as the subjects of tweets that are most frequently recirculated or replied to by the user.

The company's algorithms closely evaluate the latter, giving "a direct measure of what you're interested in," Weil said.

Between 1 and 3 percent of users who see a "promoted tweet" -- a paid ad -- click on the tweet in some way. But early beta tests have shown the engagement rate to be higher when tweets are directed using its new interest-targeting tool, Weil said, while declining to discuss specific results.

Valued at more than $8 billion but expected by analysts to make less than $300 million in revenue in 2011, Twitter has aggressively ramped up its advertising capabilities. But in streamlining its product to better show ads, the company has cracked down on how third-party services may use its content, sparking an outcry from Silicon Valley technologists who would like Twitter to remain a neutral media platform.

In protest against what they viewed as a Twitter experience increasingly corrupted by advertising, software developers in California this month launched App.net, a Twitter-like rival that is supported by a $50 membership fee rather than ads.

Laser beam used to ?paint? with molecules

Using laser beams as a paintbrush, researchers can fix molecules in three dimensional structures, a technique that could prove useful for growing biological tissues and building molecular-scale sensors.

The so-called "3-D photografting"?technique was pioneered at the Vienna University of Technology with a 3-D canvass of hydrogel, a material made of large molecules arranged in a loose meshwork.

The laser is used to fix smaller molecules in certain pores between the larger molecules, akin to filling select spaces of air between rocks in a gravel pit.

To do this, the smaller molecules are introduced to the hydrogel meshwork and then certain points are irradiated with a laser beam. The introduced molecules bond at those points.

In addition to artsy proof-of-concept molecules like the one above, the technique could useful for growing biological tissues with specific inner structures such as capillaries.

It might also be useful for building tiny chemical sensors.?

?Molecules can be positioned which attach to specific chemical substances and allow their detection,? the university explains in a news release. ?A microscopic three-dimensional ?lab on a chip? becomes possible.?

Madonna to US fans: Appreciate your freedom

PHILADELPHIA (AP) ? As she kicked off the U.S. leg of her "MDNA Tour" in Philadelphia, Madonna said she was happy to party in the USA after touring Europe for three months.

The pop icon told the crowd Tuesday night they should "never forget how lucky you are to live where you live and to have the freedom that you have." She made the comments after talking about the arrest of three members of the punk-rock female band Pussy Riot. The women were sentenced to two years in prison after performing a "punk prayer" at Moscow's Christ the Savior cathedral in which they called on the Virgin Mary to deliver Russia from its leader, Vladimir Putin.

"In my travels around the world the one thing I truly witnessed is we in America have freedom of speech, freedom of expression," the singer said.

Madonna, who toured most of Europe from June to August, has called for the Pussy Riot members to be freed. Paul McCartney and Peter Gabriel also have spoken in the women's favor.

"I don't think that it's a coincidence that I'm in the city where the Declaration of Independence was signed," Madonna said at the Wells Fargo Center to nearly 20,000 fans. "We are in the land of democracy."

Russian activists recently sued Madonna for millions of dollars, claiming they were offended by her support for gay rights during her show in St. Petersburg. A law passed in February makes it illegal to promote homosexuality to minors, and the author of that law has pointed to the presence of children as young as 12 at Madonna's concert on Aug. 9. (Minors also attended Madonna's U.S. show.)

When speaking about Pussy Riot, Madonna said that about 80 gay men were jailed in St. Petersburg because of their sexual orientation. She told the crowd that the arrests were unfair, and they booed in her support.

Then the 53-year-old told the U.S. audience: "Don't get fat and lazy and take that freedom for granted."

Madonna kicked off her concert late on Tuesday, apologizing to the crowd, who began to boo before she hit the stage around 10:30 p.m. EST.

"We had many changes to make from Europe to America, and I wanted the show to be perfect for you because my fans deserve it and quite frankly I deserve it," she said.

She performed for nearly two hours, starting in a skin-tight black ensemble with a gun in hand as she sang the song "Girls Gone Wild" from her latest album "MDNA." She transitioned to "Revolver," as she and her background dancers held guns and bullets appeared on the backdrop. (Madonna posted on her website that she does not condone violence or the use of guns and she's using fake guns in concert as a metaphor for strength.) During the next song ? "Gang Bang" ? she shot a man and spat what appeared to be liquor in his face, while blood spats and bloody hands appeared on the screen.

The dark mood escaped as Madonna changed into a red and white marching band get-up, singing "Express Yourself" and "Give Me All Your Luvin'" as a marching band played to the crowd. She sang some of Lady Gaga's "Born This Way," pulling up her skirt to reveal her red shorts.

Madonna's performances of "Celebration" and "I'm Addicted" were also colorful, as laser lights beamed and the venue became nightclub-like. Madonna's best vocal performance, though, was during "Like a Prayer," which featured more than 30 back-up singers in robes. She got the best response from the crowd when she performed "Vogue," as the dancers and Madonna ? now in a corset, long gloves and her hair pulled back ? strutted in black and white onstage.

She got racy during "Like a Virgin" and "Human Nature," taking off her shirt to reveal her bra, and pulling down her pants to reveal her thong (she wore fishnet stockings).

"Sometimes it's easier to show your (butt) than show your feelings. Maybe tonight we can all live dangerously," said Madonna, who had the words "No Fear" on her back.

Supreme Court Grants Petition for Cert in Already, LLC v. Nike, Inc ...

On June 25, 2012, the Supreme Court granted certiorari in Already, LLC v. Nike, Inc., No. 11-982, on the issue of whether a federal district court is divested of Article III jurisdiction over a party?s challenge to the validity of a federally registered trademark if the registrant promises not to assert its mark against the party?s then-existing commercial activities.? The issue in Already concerns a tactic commonly used in trademark cases: the holder of a trademark registration signs a covenant not to sue the alleged infringer so as to divest the district court of jurisdiction over the infringer?s declaratory judgment claim or counterclaim for cancellation of the mark.? The same tactic is commonly used in patent cases, where the patentee may covenant not to sue the alleged infringer in order to avoid the infringer?s allegations that the patent in suit is invalid, unenforceable or not infringed.? When successfully used, this maneuver allows the plaintiff to live to fight another day, perhaps against an opponent without the funds (or motivation) necessary to mount a successful defense.???

In the Already action, Plaintiff Nike, Inc. (?Nike?) filed a complaint against defendant Already, LLC (?Already?) alleging trademark infringement, false designation of origin, unfair competition, and trademark dilution in violation of 15 U.S.C. ?? 1141(1), 1125(a), 1125(c), and related claims under New York law, based on Already?s allegedly infringing shoe design.? Nike, Inc. v. Already, LLC, 663 F.3d 89, 91 (2nd Cir. 2011). ?Nike claimed that Already infringed Nike?s U.S. Trademark Registration Number 3,451,905 (the ??905 Registration?) for the design of Nike?s popular ?Air Force 1? shoe by selling shoes with ?a confusingly similar imitation? of the Air Force 1 design.? Id. at 92.? In response, Already filed counterclaims for a declaratory judgment that the ?905 Registration was not a trademark under 15 U.S.C. ? 1127 or New York Law, and for cancellation of the ?905 Registration.? Id.?

In response, Nike delivered a covenant not to sue Already for any of Already?s ?current, and/or previous footwear product designs, and any colorable imitations thereof? regardless of whether the footwear was used in commerce before or after the effective date of the covenant.? Id.? Nike then dismissed its own claims against Already and moved to dismiss without prejudice Already?s counterclaims on the basis that the district court did not have subject matter jurisdiction over the counterclaims because there was no longer a case or controversy concerning the ?905 Registration due to Nike?s covenant not to sue.? Id. at 93.? The district court dismissed Already?s counterclaims, determining that there was no longer a ?substantial controversy, between the parties having adverse legal interests, of sufficient immediacy and reality to warrant the issuance of a declaratory judgment.?? Id.; see also Nike, Inc. v. Already, LLC, 2011 U.S. Dist. LEXIS 9626, at *6-23 (S.D.N.Y. 2011).? The Court of Appeals for the Second Circuit affirmed.? Id. at 91.?

The Second Circuit held that Nike?s covenant not to sue stripped the district court of jurisdiction over Already?s counterclaims because the language of the covenant covered both present and future products from Already; as the court put it, it is ?hard to imagine a scenario that would potentially infringe the ?905 and yet not fall under the covenant.?? Id. at 97.? Thus, the Second Circuit held that any adversity of legal interests between Nike and Already was not ?real and substantial? and was not distinguishable from ?an opinion advising what the law would be upon a hypothetical state of facts.?? Id.? Accordingly, per the Second Circuit, the covenant rendered Already?s counterclaims moot and divested the district court of subject matter jurisdiction over the declaratory judgment claims.? Id.

Subsequently, Already filed a petition for certiorari with the Supreme Court on the issue of whether a covenant not to sue covering only then-existing commercial activity divests the district court of subject matter jurisdiction over a declaratory judgment action for trademark cancellation, and the Supreme Court granted review.? Already?s petition focused on the possibility for adversity resulting from future changes to the non-IP holder?s product, and on an apparent split between the Second and Ninth Circuits concerning the effect of a covenant not to sue on district courts? jurisdiction over declaratory judgment claims of trademark cancellation.

Under the Declaratory Judgment Act, a district court has jurisdiction over a declaratory judgment action only when there is an ?actual controversy.?? 28 U.S.C. ? 2201(a); U.S. Const. Art. III, ? 2; SEC v. Med. Comm. for Human Rights, 404 U.S. 403, 407 (1972).? The controversy must be of ?sufficient immediacy and reality to warrant the issuance of a declaratory judgment.?? MedImmune, Inc. v. Genentech, Inc., 549 U.S. 118, 127 (2007).? Further, this controversy must be present at all stages of review, not merely at the time the complaint is filed.? Preiser v. Newkirk, 422 U.S. 395 (1975).? Thus, the rationale is that by covenanting not to sue, the patent or trademark holder has eliminated any ?actual controversy? between the parties and thus, there is no longer any basis for declaratory judgment concerning the invalidity of the patent or cancellation of the mark. ??

The conflicting line of authority posited by Already is illustrated in Bancroft & Masters, Inc. v. Augusta National Inc., 223 F.3d 1082 (9th Cir. 2000).? In Bancroft, Augusta National, Inc. (?ANI?) initially sent a letter to Network Solutions, Inc., the domain name registrar, challenging Bancroft & Masters, Inc.?s (?B&M?) use of the domain name ?Masters.com.?? Id. at 1085.? B&M then filed a complaint against ANI seeking a declaratory judgment that B&M?s use of the domain name ?Masters.com? did not infringe on ANI?s trademarks for the term ?Masters? and a separate claim for cancellation of ANI?s trademarks.? Id. ?After the district court dismissed B&M?s complaint for lack of personal jurisdiction, ANI offered to waive all of ANI?s trademark infringement, dilution, and unfair competition claims against B&M for B&M?s use of the domain name ?Masters.com,? so long as B&M agreed not to enter into the golf business.? Id. ?

On B&M?s appeal from the district court?s dismissal for lack of personal jurisdiction, the Ninth Circuit addressed the threshold issue of whether the district court had subject matter jurisdiction over the action after ANI offered to conditionally waive all of its claims.? Id.? The court held that the district court had jurisdiction over B&M?s claim for declaratory judgment because it was not ?absolutely clear? that ANI would never seek to prevent B&M from using the ?Masters.com? domain name in the future.? Id.? The reason it was not ?absolutely clear? is because ANI?s promise to waive its claims against B&M was an incomplete and qualified promise, conditioned on B&M staying out of the golf business.? Id.? Further, in dicta, the Ninth Circuit suggested that, even if ANI?s promise had been unqualified, B&M?s separate claim for trademark cancellation under the Lanham Act would not have been moot because it was separate from the declaratory judgment claim for the determination of rights and was not obviously meritless.? Id.? Further, the court stated that the district court had subject matter jurisdiction over the trademark cancellation claim because the Lanham Act authorizes district courts to order trademark cancellation in any action involving a mark.? Id.?

The implications of the Already action for patent infringement cases are apparent.? The Federal Circuit has long held that a sufficiently broad covenant not to sue for patent infringement divests the trial court of subject matter jurisdiction over a declaratory judgment claim that the patent is invalid or not infringed.? See Super Sack Mfg. Corp. v. Chase Packaging Corp., 57 F.3d 1054, 1060 (Fed Cir. 1995) (?Super Sack?s promise not to sue renders any past or present acts of infringement that Chase may or may not have committed irrelevant to the question of whether a justiciable controversy remains.? The residual possibility of a future infringement suit based on Chase?s future acts is simply too speculative a basis for jurisdiction over Chase?s counterclaim for declaratory judgments of invalidity.?).? This is true even where the covenant does not, on its face, cover after-developed products.? See Amana Refrigeration, Inc. v. Quadlux, Inc., 172 F.3d 852, 855 (Fed. Cir. 1999) (?Quadlux?s promise not to assert any infringement claim against Amana under the patent as it presently reads, with respect to any product previously or currently advertised, manufactured, marketed, or sold by Amana, removed any reasonable apprehension that Amana will face an infringement suit based on its activities before the filing date.?). ??

While the Federal Circuit?s rule that a covenant not to sue divests the trial court of jurisdiction of declaratory judgment claims has come under criticism, e.g. Benitec Australia, Ltd. v. Nucleonics, Inc., 495 F.3d 1340, 1350 (Fed Cir. 2007) (Dyk, T., dissenting), the court has shown no inclination to loosen the reins for district court jurisdiction in the face of a broadly-stated covenant not to sue.

The Supreme Court?s decision could have lasting effects on the intellectual property litigation landscape.? The fact that the Court granted certiorari in this case suggests that it may be poised to require that covenants not to sue encompass products and product designs that have not yet been commercialized in order to divest district courts of jurisdiction over a declaratory judgment claim for trademark cancellation or patent invalidity, unenforceability, or noninfringement.? In Bancroft, the terms of the waiver offered by ANI to B&M were unclear and the terms that were known were qualified by the condition that B&M stay out of the golf business.? Bancroft, 223 F.3d at 1085.? In contrast, the covenant in Already was clear and covered all then-existing products and any future ?colorable imitations? of the Air Force 1, without condition.? Nike, 663 F.3d at 91.? Thus, the divergent results in these cases could fairly easily be harmonized, and the purported Circuit split resolved, without disrupting the current state of the law with respect to covenants not to sue and Article III jurisdiction.? In fact, this very argument was advanced by Nike in the briefing regarding Already?s petition for cert.? Brief in Opposition at pp. 12-20, Already, LLC v. Nike, Inc., 2012 U.S. LEXIS 4718 (2012) (No. 11-982).? In this light, the Supreme Court?s decision to review the case suggests that it may have a more sweeping intention in mind.? ?

In the event that the Supreme Court holds that jurisdiction may only be defeated by a covenant that abjures suit against an alleged infringer not only with respect to current products and designs but also for not-yet-developed or commercialized products and designs, then the granting of a covenant not to sue would carry a real cost?that of fully immunizing an opponent from suit under the pertinent mark or patent.? This would make it even more important that intellectual property rights holders thoroughly vet the decision to pursue patent or trademark litigation, including evaluating the risk that the adversary will produce evidence that could put the viability of the holder?s intellectual property at risk.

SEAL book raises questions about bin Laden's death

WASHINGTON (AP) ? A firsthand account of the Navy SEAL raid that killed Osama bin Laden contradicts previous accounts by administration officials, raising questions as to whether the terror mastermind presented a clear threat when SEALs first fired upon him.

Bin Laden apparently was shot in the head when he looked out of his bedroom door into the top-floor hallway of his compound as SEALs rushed up a narrow stairwell in his direction, according to former Navy SEAL Matt Bissonnette, writing under the pseudonym Mark Owen in "No Easy Day." The book is to be published next week by Penguin Group (USA)'s Dutton imprint.

Bissonnette says he was directly behind a point man going up the stairs in the pitch black hallway. Near the top, he said, he heard two shots, but the book doesn't make it clear who fired them. He wrote that the point man had seen a man peeking out of a door on the right side of the hallway.

The author writes that the man ducked back into his bedroom and the SEALs followed, only to find the man crumpled on the floor in a pool of blood with a hole visible on the right side of his head and two women wailing over his body.

Bissonnette says the point man pulled the two women out of the way and shoved them into a corner. He and the other SEALs trained their guns' laser sights on bin Laden's still-twitching body, shooting him several times until he lay motionless. Only when they wiped the blood off his face, were they certain it was bin Laden.

The SEALs later found two weapons stored by the doorway, untouched, the author said.

Administration officials briefing reporters in the days after the May 2011 raid in Pakistan said the SEALs shot bin Laden only after he ducked back into the bedroom because they assumed he might be reaching for a weapon.

National Security Council spokesman Tommy Vietor would not comment on the apparent contradiction late Tuesday. But he said in an email Wednesday, "As President Obama said on the night that justice was brought to Osama bin Laden, 'We give thanks for the men who carried out this operation, for they exemplify the professionalism, patriotism and unparalleled courage of those who serve our country.'"

"No Easy Day" was due out Sept. 11, but Dutton announced the book would be available a week early, Sept. 4, because of a surge of orders due to advance publicity that drove the book to the top of the Amazon.com and Barnes & Noble.com best-seller lists.

The Associated Press purchased a copy of the book Tuesday.

The account is sure to renew questions about whether the raid was intended to capture or simply to kill bin Laden. Bissonnette writes that during a pre-raid briefing, an administration lawyer told them that they were not on an assassination mission. According to Bissonnette, the lawyer said that if bin Laden was "naked with his hands up," they should not engage him. If bin Laden did not pose a threat, they should detain him.

A former deputy judge advocate general for the Air Force said the shooting was understandable according to the orders the SEALS had.

"It wasn't unreasonable for the SEALs to shoot the individual who stuck his head out," said the former JAG, ret. Maj. Gen. Charlie Dunlap, who now teaches at Duke University law school.

"In a confined space like that where it is clear that there are hostiles, the SEALs need to take reasonable steps to ensure their safety and accomplish the mission," Dunlap said.

Dunlap adds that shooting bin Laden's fallen form was also reasonable in his legal opinion, to keep the terrorist from possibly blowing himself up or getting a weapon and shooting at the SEALs.

In another possibly uncomfortable revelation for U.S. officials who say bin Laden's body was treated with dignity before being given a full Muslim burial at sea, the author reveals that in the cramped helicopter flight out of the compound, one of the SEALs was sitting on bin Laden's chest as the body lay at the author's feet in the middle of the cabin, for the short flight to a refueling stop inside Pakistan where a third helicopter was waiting.

Bissonnette writes that none of the SEALs were fans of President Barack Obama and knew that his administration would take credit for ordering the raid. One of the SEALs said after the mission that they had just gotten Obama re-elected by carrying out the raid.

But he says they respected him as commander in chief and for giving the operation the go-ahead.

Bissonnette writes less flatteringly of meeting Vice President Joe Biden along with Obama at the headquarters of the 160th Special Operations Aviation Regiment after the raid. He says Biden told "lame jokes" no one understood, reminding him of "someone's drunken uncle at Christmas dinner."

Beyond such embarrassing observations, U.S. officials fear the book may include classified information, as it did not undergo the formal review required by the Pentagon for works published by former or current Defense Department employees.

Officials from the Pentagon and the CIA, which commanded the mission, are examining the manuscript for possible disclosure of classified information and could take legal action against the author.

In a statement provided to the AP, the author says he did "not disclose confidential or sensitive information that would compromise national security in any way."

Bissonnette's real name was first revealed by Fox News and confirmed to the AP.

Samsung shares plunge after Apple patents verdict

Shares in Samsung Electronics opened 6.75 percent lower Monday after a US court fined the South Korean firm $1.05 billion for breaching Apple's patents.

After 15 minutes of trading the shares had fallen by 6.81 percent to 1,187,000 won.

A jury in San Jose, California ruled Friday that Samsung infringed six Apple patents for smartphones or tablet PCs.

Analysts said the judge in the case could later decide to triple the damages because jurors found Samsung acted "wilfully". They rejected the Korean firm's counterclaims against Apple.

Samsung has said it would contest the verdict.

"The context of the loss in this case is a lot worse than had been expected," including the amount of damages Samsung is now facing, said Hi Investment and Securities analyst Song Myung-Sup.

If the ruling leads to a US sales ban on the Samsung products subject to dispute, it will start eating away the company's revenue from the fourth quarter, Song said.

Analysts said a key point would be whether the patents battle spreads to Samsung Electronics' flagship Galaxy S III phone. The products ruled to have infringed Apple's patents are all older models.

Lance Armstrong takes part in bike race amid controversy

ASPEN, Colo. (AP) ? For a few hours, Lance Armstrong was back in his element ? on a bike and in a race.

No controversies, little fanfare.

The escape Saturday into the mountains around Aspen, Colo., comes a day after the U.S. Anti-Doping Agency disciplined Armstrong with a lifetime ban from professional cycling and vacated his seven Tour de France titles after deciding he used performance-enhancing drugs.

There were only a handful of fans at the start of the Power of Four mountain bike competition, a 36-mile trek that includes plenty of climbing.

Asked if he was ready, Armstrong smiled and said, "I hope so. ... This is going to be hard for all of us."

Decked out in black and gold and sporting a Livestrong emblem on his jersey, Armstrong tinkered with his bike and gave a kiss to girlfriend Anna Hansen before pedaling off.

His busy weekend includes a marathon Sunday. He may be banned from cycling, but it hasn't diminished his passion for competition.

These weekend races may have to suffice.

Armstrong, who retired a year ago and turns 41 next month, said Thursday he would no longer challenge USADA and declined to exercise his last option by entering arbitration. He denied again that he took banned substances in his career, calling USADA's investigation a "witch hunt" without any physical evidence.

USADA said its evidence came from more than a dozen witnesses "who agreed to testify and provide evidence about their firsthand experience and/or knowledge of the doping activity of those involved in the USPS conspiracy," a reference to Armstrong's former U.S. Postal Service cycling team.

The unidentified witnesses said they knew or had been told by Armstrong himself that he had "used EPO, blood transfusions, testosterone and cortisone" from before 1998 through 2005, and that he had previously used EPO, testosterone and Human Growth Hormone through 1996, USADA said. Armstrong also allegedly handed out doping products and encouraged banned methods ? and used "blood manipulation including EPO or blood transfusions" during his 2009 comeback race on the Tour de France.

USADA chief executive Travis Tygart described the investigation as a battle against a "win-at-all-cost culture," adding that the International Cycling Union was "bound to recognize our decision and impose it."

Fans defended Armstrong on Twitter, insisting his work with Livestrong trumps what he accomplished on a bike. His success helped sell millions of "Livestrong" yellow plastic bracelets as he promoted cancer awareness and research. He's raised nearly $500 million since the Lance Armstrong Foundation started in 1997.

On Friday alone, the foundation said it received 400 donations that totaled around $75,000.

On Thursday, Emken brought her campaign and message to Redlands, where she spoke to a room full of people at a special Redlands Townhall Patriots meeting at the American Legion Hall off Colton Avenue.

The not-so-well-known candidate was not afraid to pull punches when it came to explaining why she was running. The reason: to get long-time Sen. Dianne Feinstein, D-Calif., out of office and repeal President Barack Obama's health care reforms.

"Health care is my area of expertise," Emken said. "We have a huge problem (now and) we had a huge problem before Obama came to town with health care delivery and health insurance," she said. "Somehow this new team took a bad problem and now they're making it worse. And folks, that was quite a trick. Obamacare is the end of our health care system as we know it if it is not repealed.

"It's a political tool now for Obama," she said. "And (we need) to get a new president or a new Senate and we can get this thing repealed."

Emken graduated from UCLA in 1984 where she earned dual degrees in economics and political science.

For several years, she worked as an efficiency cost cutting expert for IBM, and most recently worked as vice president for government relations at Autism Speaks, the nation's largest science and advocacy organization devoted to fighting autism.

During her time with the non-profit organization, Emken said, she has worked with former Republican presidential candidate Rick Santorum to create new legislation for those suffering from autism, and launched a multi-state campaign to secure insurance coverage for autism-related services.

Emken said if she's elected to the Senate, she plans to roll up her sleeves and take care of business.

"I'm committed to going back (to Washington) and making the tough decisions that we have to make to balance the budget to reduce our debt and to make our economy competitive again, and to get it growing," she said. "I'm going to lower corporate taxes. I'm going to look at every agency, every piece of the budget - nothing's off limits, especially entitlements.

"I'm going to stand next to my friend Paul Ryan," she also said, referring to Republican presidential candidate Mitt Romney's running mate, "and we are going to deal with entitlements in an authentic way."

Emken said Feinstein has not come up with solutions to help California.

"She's got a lot of people fooled because she's been very good about giving the presence of someone who is going to be (open) to what you want," she said. "Let me tell you folks, after 42 years in political office ... if she hasn't done it by now, she is not going to do it any time soon.

"Who would imagine that somehow - in the next six years - she's going to get something done? She's a big talker."

Emken said Feinstein is also out of touch with what Californians are going through, especially when it comes to unemployment and foreclosures.

"She has no idea what your families are going through," Emken said, adding that she is very different from her opponent. "People want somebody who is authentic. They want to know that they aren't just looking for another line on their resume."

Emken said her campaign is truly grassroots. And while she said she does not have millions to spend on campaign ads, she said, she is working her way around that using social media and providing commentary on CNN and conservative commentator Dennis Prager`s radio show.

(AP) ? Fresh clashes broke out Friday in northern Lebanon between supporters and opponents of the Syrian regime, killing two people and wounding 17 others, Lebanese security officials said.

The fighting in the port city of Tripoli was the latest instance of the Syrian civil war causing unrest next door in Lebanon, a country long under Syrian influence.

In Syria itself, fighting raged Friday between government forces and rebels close to the capital.

The British-based Observatory for Human Rights said troops pursued rebels in the town of Daraya, just south of Damascus, the scene of heavy fighting over the last two days. Fifteen people died Friday, most of them from injuries suffered in battles the day before, said the group, which relies on a network of activists on the ground.

Residents of Damascus reporting hearing loud explosions as shells fired from the Qasioun mountains overlooking the capital slammed into Daraya and the nearby suburb of Moadimiyeh.

Human rights groups say more than 20,000 people have died since the Syrian uprising against President Bashar Assad erupted in March 2011.

The bloodshed in Syria has drawn neighboring Lebanon deeper into the unrest ? a troubling sign for a country that suffered its own 15-year civil war from 1975 to 1990 and has an explosive sectarian mix of Sunni and Shiite Muslims, Christians and Palestinian refugees, as well as deep divisions between pro- and anti-Syrian factions.

Syria was in virtual control of its smaller neighbor for many years, posting tens of thousands of troops in Lebanon, before withdrawing under pressure in 2005. Even without soldiers on the ground, Syria remains influential, and its civil war has stirred longstanding tensions that have lain under Lebanon's surface.

The clashes of the past few days in Tripoli represent some of the most serious fighting in Lebanon in several months.

The mostly Sunni city weathered gunbattles in May, when fighting over Syria killed eight people.

In the latest clashes, gunmen from the Sunni neighborhood of Jabal Mohsen battled armed elements from the neighboring district of Bab Tabbaneh, which is populated mostly by followers of the Alawite sect, an offshoot of Shiite Islam.

Assad comes from Syria's Alawite minority, while rebels fighting his regime are mostly Sunnis.

Officials said the two sides used automatic rifles and rocket-propelled grenades in intermittent fighting in Tripoli Friday. They said among those wounded by sniper fire was a technician working with journalists in the area.

The officials spoke on condition of anonymity because they were not authorized to brief reporters.

The latest round of fighting erupted Monday. Several attempts to mediate a cease-fire have failed. At least 15 people have been killed in the city this week, and more than 100 have been wounded.

FoldingText Is a Plain Text Editor for Mac with Hidden FeaturesMac: You won't find a shortage of great plain text editors for Macs, but FoldingText brings a few new things to the table. These include Markdown-style auto formatting, an interesting text hiding mechanic, Applescript automation, and more.

At its core, FoldingText is a pretty straightforward plain text editor. Underneath the hood are some neat features though. For instance, you can create a new header for a document simply by hitting the "#" sign. Underneath that, you can hit "-" to automatically create a to-do list box, or just type away a few lines. When your document gets long and out of control, you can click on the "#" sign to fold the text up so you don't have to look at it. The folding makes organizing big documents a lot easier, and navigation is simplified. You can also set up a Pomodoro style timer. FoldingText is less of a text editor than it is a text outliner, but fans of plain text editing should check it out. FoldingText is still in beta, and while it is you can try it out for free from the developers site below.

Officials close Boca stadium after fan violence

BUENOS AIRES, Argentina (AP) -Government security officials have closed Boca Juniors' stadium as a penalty for fan violence at the end of a match on Wednesday against Independiente in the Copa Sudamericana.

Dario Ruiz, a top official of the office of Security Policy, on Thursday said Boca's Bombonera stadium would be closed for at least one league match.

Violence broke out after Independiente earned a 3-3 draw with a late penalty, and fans near the Independiente bench ripped down an advertising board. Boca said in a statement that it had identified four fans involved and said they would be banned from entering the stadium.

Violence threatens many matches in Argentine football, where hooligan gangs rule areas in and around the stadiums.

Kodak selling off iconic film business to pay off debt

I tend not to watch music award shows much anymore. It seems over the years, they?ve gone from great musical acts kicking butt with some bright lights to overly produced and tightly scripted shows that appear to be more artistic and creative, but they?re not.

Music in and of itself is art. If it?s great, it doesn?t need a big production around it.

Two of the best concerts I have seen in my lifetime as an Eric Clapton concert and a Robert Cray concert. No fancy light shows. No opening acts. Just two artists playing music for nearly 2 hours and blowing it up.

Don?t get me wrong. I?ve been to shows there the production value is high. I saw AC/DC and they rolled out actual cannons when playing ?For Those About To Rock? and had a huge bell go out over the audience when they played ?Hells Bells.? Iron Maiden had spectacular pyrotechnics and big mechanical versions of their mascot ?Eddie? walking around. But those shows also featured musicians playing their guts out.

How many times have you watched a music act on an awards show today and just know that it?s lip synced? This example has been debated, but I think there is lip syncing going on. Still, the fact that it needs debate is just odd. Here?s Katy Perry from the 2012 Grammy Awards:

There was no doubt at all however about Chris Brown?s performance. Total lip sync:

Now let?s step back in time to 1991. Arsenio Hall was cool late night talk show host and as such, was asked to host the MTV Video Music Awards. Let?s take a look at two young stars at the time. First up, Mariah Carey. She was only 21:

And a young LL Cool J. He was only 23 and just killed it with ?Momma Said Knock You Out?:

Want to rock? Same awards show. Van Halen with Eddie Van Halen starting things off with his guitar?and a drill:

Granted, not everybody takes the easy way out. Adele tore it up during the Grammy Awards as did the Foo Fighters. In fact Dave Grohl called out the other ?artists? who seem to be more concerned about everything being just right. When accepting the award for Best Rock Performance he said:

?To me this award means a lot because it shows that the human element of music is what?s important. Singing into a microphone and learning to play an instrument and learning to do your craft, that?s the most important thing for people to do.

It?s not about being perfect, it?s not about sounding absolutely correct, it?s not about what goes on in a computer. It?s about what goes on in here [your heart] and what goes on in here [your head].?

Spot on.

And here is the real problem, and it?s not just a part of the music world (in a sense, I wouldn?t even say it was the musical world as much as it is the music business world) and the overall business world:

We are afraid to take risks.

We have become so scared of making a mistake or failing at something. Our culture has taught us to play it safe as much as possible. But where does that get us?

If we choose not to step outside of our comfort zone and risk failure, we are never going to rise above mediocrity with our art or our work.

20 years ago, a 21 year old singer and a 23 year old hip hop artist took to the stage and gave it 110% with no use of auto-tuning, not a huge spectacular stage show and no fear of failure. The result was the art of music at its best.
